
Foreign nationals can become permanent residents of Germany by setting up a company in the country. By making a total capital investment of €262,250 (approx. ₹2.26 crores) over three years, for incorporating and operating a company in Germany (of which €133,000 can be recovered the investor in the form of share capital retained and salary received), immigrants from all walks of life can attain the EU Blue Card residency permit.
This allows them to live and work in Germany – with family – for four years, and eventually transition to permanent residence (PR) or simply renew the Card if they wish to remain temporary residents.
Step 1: After due eligibility verification, initiate company incorporation via local lawyers in Germany, and open a German bank account – preferably by visiting Germany, although the visit is not mandatory at this stage.
Step 2: Choose whether to incorporate a new limited liability company by investing share capital of €25,000 (approx. ₹21.5 lakhs), or establish a subsidiary of an existing company in Germany. Subsequently, the contracts must be drafted and notarized by a Notary.
Step 3: Set up a company bank account in Germany and transfer the share capital funds. Proof of this transfer is shared with the County Registry by the Notary. The company will be registered within the next two to four weeks. After that, the company must be registered with tax authorities.
Step 4: Transfer working capital salary of €180,000 (approx. ₹1.5 crores) and visit Germany to commence the immigration process by signing an employment contract with the company they have incorporated, provide biometrics, lease an accommodation, and then apply for a Blue Card.
Note: If the applicant wishes to switch jobs after two years of employment Germany, they need the permission of the Foreigner’s authority to do so.
Step 5: After the visit, the investor and their family members will receive the Blue Card. The investor can apply for PR after 21 or 33 months, depending on their level of proficiency in the German language. The company should remain operational until PR is obtained. The family members can apply for PR after five years of temporary residence in Germany.
