Step-by-step to achieve USA EB-5 Visa

Step 1 – Choose the EB-5 Project

• Direct EB-5 Investment – Under the direct EB-5 investments, foreign investors invest their EB-5 capital directly in a new commercial enterprise (NCE). And, they must generate a minimum of 10 full-time jobs for U.S. workers.
• Regional Center EB-5 Investment – Under the regional center scheme for USA business visa from India, investors need to pool their money (Min. USD 800,000) in a larger NCE via a USCIS-approved regional center. The pooled capital will be used to buy equity stakes in an EB-5 regional center’s investment fund which will either buys equity or loans capital to a job-creating entity.

Step 2 – Invest the Capital amount and File an I-526 Petition

• Investor must invest a minimum of USD 800,000 if the project in located within a targeted employment area (TEA) or rural area or high unemployment area. Moreover, investors can also invest USD 1,050,000 for projects located outside the targeted employment area (TEA)
• Forms I-526 – For investors applying USA EB5 Green Card under EB-5 Visa Direct investment scheme,
• I-526E – For Investors who choose Regional Center scheme

Step 3 – File for Conditional Permanent Resident Status

• Once the I-526 or I-526E petition is approved, investors can apply for conditional permanent resident status which allows them to stay permanently in U.S. for two years. After two years, investors can switch their status from conditional permanent residency to Green Card Residency.
• Investors Outside the United States – They must submit Form DS-260 to the National Visa Center through their home country’s U.S. consulate to enter the United States.
• Investors Inside the United States – Investors who are lawfully residing in the United States, they must file Form I-485 to switch to conditional permanent resident under USA business visa.

Investors can now file Form I-485 and I-526 / I-526E petition concurrently.

Step 4 – File I-829 Petition for Permanent Resident Status

• Once your conditional permanent residency expires after two years, you can apply for I-829 petition to maintain your permanent resident status. It will validate that, you have maintained your investment and generated 10 full-jobs adhering to EB-5 program regulations for two years.
• Once the I-829 petition is approved, the investor, spouse, and unmarried children (under the age of 21) will attain lawful permanent resident status under USA business visa from India
